[2012] UKOGB Civ 1: Ashby and Others v Don Valley Steel Holdings Ltd
Judgment given on 14 May 2012. Judgment for the claimants: 90 per cent of pensions restored, with costs. Held: A pension is not a gift. It is wages, earned and deferred. Trustees who let an employer stop paying in, and stand by while assets are moved beyond the scheme's reach, are in breach of trust.
